Today in the forthcoming blog we are trying to answer one of your most important questions regarding intellectual property issues, it seems today one of the most important concepts with the advancement of science and technology, especially the Internet in the field of intellectual issues and Ownership is a matter of intellectual property.

 In order to understand what intellectual property is, we must first provide a simple and comprehensive definition of the concept, which is the right that exists for every creative, artist, and etc.. From what they created and derived from their thought; In other words, “intellectual property refers to a right that protects a creative work, an innovation and a business reputation from the dangers.”

For example, designers have a right to their idea and work because of their idea and creativity, and writers because of the work they have created, which is called intellectual property. In fact, intellectual property is a movable property that involves initiative and imagination, also are commonly known as “intellectual creatures”.

Copyright, trademarks, trade secrets and patents are among the types of intellectual property. Intellectual property rights support these activities, ideas, designs, etc., which do not seem to have a material aspect, in order to promote science and motivation in society, as well as consider the rights of individuals.

Now the question arises what is the law of  intellectual property in Iran? Do Iranian laws provide a place for this right to be realized or not? In this regard, it should be noted that the issue of intellectual property has been considered for a long time, the “Law on Registration of Trademarks and Inventions” approved in 1310 and its amending regulations approved in 1338 deal with the right of inventor and intellectual property in the field of industry and trade.

The International Covenant known as the “Paris Union for the Protection of Industrial, Commercial and Agricultural Property” adopted in 1883, to which Iran acceded in 1337, is another legal document of Iran in this field. In the field of copyright and artist, the Law on the Protection of the Rights of Authors, Writers and Artists adopted in 1348 and its executive regulations approved in 1350 along with the “Law on Translation and Reproduction of Books, Publications and Audio Works” adopted in 1352 are legal sources in Iranian law in this field. Approval of the Law on Protection of Geographical Indications of Goods (approved on2004) and related regulations (approved in 2005), on the other hand, approval of the Law on Patents, Industrial Designs, Trademarks (approved in 2007) and related executive regulations (approved in 2008) are examples of efforts made to legalize the concept of intellectual property in Iran.

Another issue that seems to be familiar with is how to register patents in Iran. Patent applicants can apply for a patent by visiting the Intellectual Property Site of Patents, which you can access here. For a brief explanation of the patent process, it should be noted that the submission of a patent application is possible only electronically and by logging in to the user account.
